II. general conditions of use.

Article 1: Purpose.

The purpose of these General Terms and Conditions of Use (hereinafter referred to as the "GTCU") is to define the terms and conditions under which the Publisher provides Internet users (hereinafter referred to as "Internet users") of the GeoDE Site (hereinafter referred to as "the Site") with the associated services and the manner in which Internet users access the Site and use its services.

The Site offers the following services free of charge:

GeoDE is a Web platform for disseminating geographic information offered by CIRAD.

It allows any Internet user to :

Internet users with extensive rights, hereinafter referred to as "Users", may, depending on the nature of these rights, :

GeoDE is a platform operated by CampToCamp, based on the geOrchestra open-source solution, and adapted to CIRAD's needs through a public contract.

It is based on four specific software bricks:

geOrchestra ensures interconnection between the four bricks above, offering centralized administration of access and functional rights. geOrchestra embeds the Console, Datafeeder, Analytics and GeoNetwork-UI modules developed by CampToCamp.

The version of these GCU currently on line (v.1.0 of May 2025) is the only one opposable during the entire period of use of the Site and until a new version replaces it. The Publisher reserves the right to modify these GCU at any time and without notice, in order to adapt them to changes in the Site and its operation.

If the planned modifications constitute a major revision of the personal data policy, a notice will be placed on the Site to inform Internet users and Users of the modifications and to enable them to take, if necessary, the measures they deem necessary before they are implemented.

Article 2: Access to the Site

All connections to the Site are subject to compliance with the GCU.

Access to and use of the Site and the creation of an account require the knowledge and express acceptance by the Internet user and the User of all the conditions described below.

Certain services are accessible only to Site Users, who must have an account and log in using their Renater login and password in order to benefit from them.

Internet users and Site users acknowledge that they have checked that the computer configuration they are using is virus-free and in perfect working order.

It is the responsibility of all Internet users to take all appropriate measures to protect their own data, hardware and/or software from contamination by any viruses circulating on the Internet, and to ensure that their data is properly backed up.

Article 3: Site management

The Publisher endeavours to provide access to the Site 24 hours a day, 7 days a week, except in cases of force majeure as defined by the French Civil Code and subject to any breakdowns and maintenance operations, including those scheduled by the host and by the publishers of the five software bricks described in article 1, necessary for the proper functioning of the Site and services.

Consequently, the Publisher cannot guarantee the availability of the Site and services, the reliability of transmissions or performance in terms of response time or quality. No technical assistance is provided to Internet users, either electronically or by telephone.

In addition, for the proper management of the Site, the Publisher may interrupt the Site or part of the services, or limit access to all or part of the Site at any time without notice, all without entitlement to compensation.

Article 4: Site content

The information and documents appearing on the Site and accessible via the Site come from sources considered to be reliable.

However, such information and documents may contain technical inaccuracies and typographical errors for which the Publisher cannot be held responsible. The Publisher reserves the right to correct such errors as soon as they are brought to its attention.

The information and documents available on the Site are subject to change at any time, and may have been updated in particular between the time they are downloaded and the time the Internet user or User becomes aware of them.

The Editor may delete or refuse to display content that is contrary to national or international law, to accepted standards of morality or that may disrupt the operation of the Site. The Editor may also restrict or withdraw access to a User if his/her use of the Site violates these GCU, applicable laws or the rights of third parties.

Article 5: Code of conduct for users and web surfers.

5.1 User warranties

All Users guarantee that the data and databases published on the Site are suitable for distribution and comply with applicable legal provisions, in particular with regard to: protection of personal data and sensitive data, respect for privacy and intellectual property rights.

Before any publication, the User shall ensure that he holds the necessary rights and, where applicable, obtains the required authorizations from the holders of the rights concerned.

5.2 Commitments of Users and Web surfers

Every User or Internet surfer undertakes:

Data and/or databases containing personal data, including non-nominative data, allowing the re-identification of natural persons, may not be distributed on the Site unless :

Any User publishing personal data undertakes to comply with the applicable regulations, including the local regulations of the country in which the data is collected or processed.

The User or Internet surfer who re-uses data or databases containing personal data must comply with the legislation relating to the protection of personal data in force in his territory and respect the conditions of the license attached to this data.

Article 7: Intellectual property

7.1 Software licenses

The Site uses five specific software bricks to which the following licenses apply:

Use of the Site implies compliance with the terms of these licenses. Internet surfers and Users therefore undertake to comply with the terms of said licenses.

7.2 Site intellectual property rights

The entire content of the Site, including backgrounds, texts, works, products, processes, code and illustrations, is protected by copyright, patent law and by the law protecting databases.

Any reproduction, representation or adaptation, in whole or in part, of the Site by any person or entity, by any process whatsoever, without the prior written consent of the holder of the rights concerned, is prohibited and constitutes an act of infringement punishable by articles L. 335-2 et seq. of the French Intellectual Property Code.

In the event of acceptance of total or partial reproduction, representation or adaptation of the Site by an individual or legal entity, the latter undertakes to cite the author and source, in accordance with article L.122-5 of the French Intellectual Property Code.

Any reproduction in whole or in part of CIRAD trademarks and logos without CIRAD's prior written consent is prohibited under articles L. 713-2 et seq. of the French Intellectual Property Code.

7.3 Rights to published data and databases

Use of the databases and files published on the Site is subject to compliance with the license chosen by the User publishing them.

When the User publishes a dataset that includes third-party intellectual property rights, he shall mention their presence in the documentation accompanying the data or database. He indicates the identity of the individual or legal entity holding these rights.

Article 8: Responsibilities

With the exception of cases of gross negligence or wilful misconduct, the Publisher shall not be held directly or indirectly liable, on any grounds whatsoever and for any reason whatsoever, for any direct or indirect damage or loss whatsoever, and in particular :

In the event of termination of the Site, the Publisher will notify Internet users and/or Users six (6) months prior to the effective termination of the Site so that they may recover and/or migrate their data to another platform. The Publisher cannot be held responsible for the loss of data if, during this period, the Internet User and/or User has not recovered and/or migrated his/her data.

The Publisher shall not be liable for any damages or indirect losses suffered by the Internet user or the User, such as loss of business, sales, profits or data.

The Publisher undertakes to promptly remove any manifestly illicit content reported to it, in particular :

Article 9: Hyperlinks

The Site may contain hypertext links to other sites on the Internet. Following the links to these other resources will cause the Internet user to leave the Site. Any information accessible via these links to other sites is not under the control of the Editor, who declines all responsibility for their content.

It is possible to create a link to the presentation page of this Site without the express authorization of the Publisher, provided that the link displays the Site in a new browser window or tab.

You are nevertheless requested to inform the Editor in advance at geode@cirad.fr, who may at any time request the immediate removal of the link without having to justify his decision.

Article 10: Applicable law and jurisdiction

These Terms of Use and the content of the Site are governed by French law.

The Internet user/User and the Publisher agree that any disputes arising out of or in connection with the present contract, which cannot be settled amicably within a reasonable period of time, shall be submitted to the competent French courts.

III. personal data policy.

Article 11: Protection of personal data.

In accordance with the French Data Protection Act No. 78-17 of January 6, 1978, as amended, and the General Regulation on the Protection of Personal Data (RGPD) No. 2016/679/EU of April 27, 2016, CIRAD, as Publisher and data controller, is committed to respecting the privacy of Internet users or Users visiting the Site and protecting their personal data. The Internet surfer or User is informed that the information collected via the Site is intended for authorized CIRAD services (Group General Administrator of GeoDE, the IT Department for technical administration and security of the Site, legal teams for requests to exercise rights and possible legal action) for the needs of the aforementioned purposes, as well as, where applicable, its possible authorized subcontractors (hosting, maintenance), including the outsourced RGPD consultant, within the limit of their need to know in compliance with the stated purposes. These service providers are bound by contractual confidentiality and security obligations.

Personal data collected and processed on the Site are protected by appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including:

In accordance with the applicable regulations, in particular the aforementioned RGPD, the Internet user or the User is informed that, depending on the case, he or she has the rights of access, rectification, deletion and portability (where applicable) with regard to data concerning him or her, as well as the right to limit and object on legitimate grounds to their processing.

In accordance with article 85 of the French Data Protection Act, as amended, the Internet surfer or User also has the right to define general or specific directives relating to the conservation, deletion and communication of his/her data after his/her death.

To this end, the Internet user or User may designate a trusted third party - certified by the CNIL - who will be informed of the fate of this data and with whom the data will be registered in the event of the Internet user's or User's death. The trusted third party may enforce these instructions. In the event of the death of the owner of the accounts and data, the trusted third party is then entitled to take cognizance of the general directives and request their implementation from the relevant data processors.

The Internet user or the User may also define specific directives with CIRAD's Data Protection Officer.

In the absence of such instructions, the heirs of the Internet user or User may - after his/her death and by producing a death certificate - exercise said rights over his/her personal data. The heirs may have the deceased's user accounts closed, object to the continuation of the processing of personal data concerning him/her, or have them updated.
The Internet User/User and/or the Heirs may exercise these rights by writing and providing a copy of the ID́ and death certificate if applicable to the following address: dpo@cirad.fr.

Where there is reasonable doubt as to the identity of the requesting party, the Publisher may ask the Internet user to provide proof of identity. In this case, the copy of the proof of identity is not kept beyond the time required for verification.

Internet users also have the right to lodge a complaint with the CNIL via its website (https://www.cnil.fr/fr/plaintes/) or by post.

Internet users or Users, visitors to the Site, are required to comply with the provisions of the Data Protection Act and the RGPD, in particular by refraining from any collection or misuse of personal data to which they have access.

Article 12: Cookie policy

This site is configured to use Matomo, an Open Source web statistics software. Matomo uses cookies, which are text files placed on your terminal that enable us to analyze the use of the Site by Internet users. These cookies are considered to be strictly necessary for browsing, as they are simple audience measurement cookies and are used to store the preferences for depositing cookies, which are only used to produce anonymous statistics on behalf of the Publisher.

12.1 Use of cookies and protection of personal data

The data generated by cookies is used by the Editor, who is responsible for processing it, to produce Site usage statistics. This processing is based on CIRAD's legitimate interest in managing its external communication media in order to improve its visibility.

The identification and connection data of Internet surfers and Users visiting the Site are processed in this way:

They are transmitted to an instance of the Matomo software, hosted and administered by the Publisher in France. IP addresses are anonymized in order to protect your privacy. Personal data is thus accessible to CIRAD teams in charge of managing the GeoDE website.

Personal data is kept for a maximum of 25 months, after which time only aggregate reports are kept, which do not allow the Internet user to be identified. Cookies have a limited lifespan of 13 months.

12.2 Setting cookies

Internet users can configure the use of cookies by selecting the appropriate option on the https://geode.cirad.fr/public/cookies.html page. They can also set their browser to refuse the transmission of cookies. Cookies already stored can be deleted at any time.

12.3 Users' and Internet users' rights

In all cases and in accordance with the applicable regulations (in particular the RGPD), the Internet user and the User have, depending on the case, the rights of access, rectification, deletion and portability (where applicable) with regard to data concerning them, as well as limitation and opposition on legitimate grounds to their processing. Users may exercise these rights by contacting CIRAD's Data Protection Officer at dpo@cirad.fr. Internet users and Users also have the right to lodge a complaint with the CNIL at any time.
